Mutual Divorce in India – Step by Step Process

When a marriage does not work out, both husband and wife may decide to separate peacefully. In such cases, the law provides for Mutual Consent Divorce, which is faster and less stressful than a contested divorce.

✅ What is Mutual Divorce?

Mutual Divorce means both husband and wife agree to end the marriage. Instead of fighting a long legal battle, they file a joint petition in court and settle important matters such as:

  • Custody of children

  • Alimony/maintenance

  • Division of property and assets

This process is covered under Section 13B of the Hindu Marriage Act, 1955 (for Hindus, Sikhs, Buddhists, Jains). Similar provisions exist in other marriage laws too.

📌 Step by Step Process

Step 1: Separation Period

  • The couple must live separately for at least 1 year before filing for mutual divorce.

  • “Living separately” doesn’t always mean living in different houses it means they are no longer living together as husband and wife.

Step 2: Filing the Joint Petition

  • Both husband and wife file a joint divorce petition in the family court.

  • The petition includes agreements on child custody, maintenance, alimony, and property.

Step 3: First Motion Hearing

  • Both spouses appear before the judge.

  • The judge records their statements and verifies that they are seeking divorce voluntarily and without pressure.

  • After this, the court passes an order for the First Motion.

Step 4: Cooling-Off Period

  • The court usually gives a 6-month waiting period.

  • This is to allow the couple to reconsider their decision.

  • In some cases, courts waive off this period if the marriage is clearly beyond repair.

Step 5: Second Motion Hearing

  • After 6 months, the couple appears in court again.

  • The judge reconfirms their consent for divorce.

  • If satisfied, the court grants a Decree of Divorce.

⏱️ Time Taken for Mutual Divorce

  • Minimum: 3 months (if cooling-off period is waived).

  • Normally: 6 months.

📄 Documents Required

  • Marriage certificate

  • Proof of separation (address documents, affidavits)

  • Passport-sized photos of husband and wife

  • Details of financial settlement, alimony, child custody agreements
